True Stories of the Oregon State Police

The following reports are taken from the Daily Log of the Oregon State Police. All individuals charged with crimes are presumed innocent until proven guilty in a court of law.

March 21: DUI and Reckless Driving Crash on SR 18, Milepost 1, Lincoln County A driver exiting Highway 101 southbound onto Highway 18 lost control, left the roadway, struck a tree, and overturned. Dwayne Loran Fallein, 66, of Otis, was transported to North Lincoln Hospital with serious injuries. Rowley’s Towing recovered the teal Mazda. Fallein was cited for DUI (intoxicants) and reckless driving.

March 22: DUII on US-101, Milepost 140, Newport Oregon State Police stopped a red Toyota Corolla near milepost 140. Danny Lynn Smith, 49, of Lowell, was found impaired and arrested for DUII (intoxicants and controlled substances). His passenger was Jasmine Coral Smith, 48, of Lowell.

March 23: DUII on Hwy 20, Milepost 25 Westbound, Eddyville A 2025 Chrysler Pacifica was reported for reckless driving. Troopers stopped Justin Alexandre Cote, 49, of Springfield, who showed signs of impairment. He performed poorly on field sobriety tests, provided a breath sample of .02% BAC and a urine test, and was arrested and lodged at Lincoln County Jail.

March 23: Non-Injury Crash on US-101 Near Milepost 113, Lincoln County Two northbound vehicles merged from two lanes into one near milepost 113. The vehicles rubbed together in a low-speed sideswipe. Edwin Ruthven Chapman, 47, of Milwaukie, and Heather Marie Johnson, 49, of Tigard, exchanged information with OSP assistance. No injuries; vehicles driven from the scene.

March 24: Hit-and-Run Crash on Business 20 and NW I Street, Toledo A 1997 Ford Ranger attempted to pass a 2010 Chevrolet Malibu over the double-yellow line in a corner, causing a sideswipe. The Ranger driver fled but was later located. Bailey Reinhold Adam, 21, was arrested and cited for failure to perform the duties of a driver in a collision with property damage (victim: Victoria Lee Johnston, 56, of Albany). Both drivers also received citations for speed racing.

March 26: Non-Injury Crash on US-101, Milepost 135, Newport A silver Subaru Crosstrek and red Jeep Compass collided. No injuries reported. Both vehicles were towed by Coast Towing. Citations/warnings were issued to drivers Yolanda Rocio Lopez Ramirez, 31, of Newport, and Maggie J. Turpin, 18, of Laramie, Wyoming.

March 27: DUII – Alcohol on N 101 Street and NW 3rd Street, Newport Troopers stopped a bicyclist near NW 3rd and US-101. Sean Anthony Posada, 26, of Newport, was found impaired and arrested for DUII (intoxicants and controlled substances).

March 28: Non-Injury Single-Vehicle Crash on Hwy 20 Near Milepost 18, Lincoln County A small truck with known brake problems attempted to park on a sloped driveway off US-20. The brakes failed; the truck rolled backward across both lanes and down the bank into Simpson Creek, rolling onto its driver’s side. Robert W. Jordan, 56, received a citation/warning. The black Ford Ranger was damaged.

March 30: Falsifying Commercial Fish Report, Newport Fish and Wildlife Troopers investigated a commercial fisherman who made a false crab landing to meet the 14-day landing requirement. Jeffrey L. Oliver, 56, of Hamilton, Montana, was cited for falsifying a commercial fish report (misdemeanor).

March 30: Disorderly Conduct and Criminal Mischief on US-101, Milepost 130, Lincoln County Troopers responded to reports at Otter Crest Viewpoint and along Hwy 101. Brian Cody Samson, 24, of Eugene, was arrested and identified by fingerprints at Lincoln County Jail. He was charged with Disorderly Conduct II and Criminal Mischief III.

March 31: Hit-and-Run Crash on Hwy 34, Milepost 10, Tidewater A vehicle crashed and was abandoned, blocking both lanes. The white Ford Explorer was damaged and towed by Coast Towing.

April 1: Injury Crash (Single Vehicle) into Ditch/Creek, Lincoln County A westbound Chevy Equinox left the road, flipped onto its driver’s side, and came to rest in a creek. Jacqueline Elizabeth Bakke, 61, reported drifting onto the shoulder. She sustained minor injuries and was transported for evaluation. Rowley’s Towing recovered the white Equinox.

April 1: Non-Injury Crash on US-101, Milepost 124, Lincoln County A Kia SUV turning southbound from Chester’s Market overestimated the gap and collided with a southbound Ford truck. No injuries; both vehicles driven from the scene. Citation/warning issued to Vicente Rufino Aparicio Cruz, 57; Sue Ann Robinson, 79, was the other driver.

April 2: Non-Injury Crash (Log Only), Lincoln County A Dodge Durango drove off the highway onto the grass shoulder and back onto the roadway, sustaining minor plastic damage. Morgan Whittney-Marie Sawin, 29, of Toledo, said she blinked and blacked out briefly. A 12-day-old infant in the back seat was properly restrained and uninjured.

April 5: Three-Vehicle Non-Injury Crash on SR 18 Near Milepost 4.9 Westbound, Lincoln County Vehicles stopped for traffic turning onto Bear Creek Road. A silver 2020 Honda HRV failed to stop and struck a white 2026 Tesla, which pushed into a grey 2024 Toyota RAV4. The Honda and Tesla were towed by Menefee Towing. Kyler William Nall, 23, was charged with failure to perform duties of a driver in a collision with property damage.

April 5: Non-Injury Crash on US-101, Milepost 157, Waldport A two-vehicle crash occurred when a driver was cited for careless driving and failing to drive within their lane. Both vehicles were towed (one by AAA, one by OSP dispatch).

April 7: Injury Crash on Private Property, Lincoln County A driver fell asleep, left the roadway, and crashed into a tree on private property. The black Toyota Sequoia was towed by Car Care Tow Pro. David Howard Elton III, 60, of Gleneden Beach, was cited for careless driving. The property owner (Hazel Katherine Evans, 68, of Otis) reported damage to a plastic garbage can and an apple tree. The driver was extricated and hospitalized.

April 7: Commercial Dungeness Crabbing Closed Season Violation, Newport Fish and Wildlife Troopers cited Daniel L. Albert, 46, of Newport, for making a crab landing after the close of the season (misdemeanor).

April 8: Commercial Dungeness Crabbing Closed Season Violation, Newport Fish and Wildlife Troopers cited Colby M. McKibben, 52, of Toledo, for making a crab landing after the close of the season (misdemeanor).

April 9: Commercial Dungeness Crabbing Closed Season Violation, Lincoln County A commercial fishing vessel landed crab not registered to the summer season and after the regular season close. Joseph M. Thompson, 66, of Newport, was cited (misdemeanor).

April 9: Welfare Check / Lost Juvenile, Gleneden Beach Area A 7-year-old girl was found alone on the beach and asked beachgoers for help finding her father. OSP located the father (Jacob James Phifer, 33, of Lincoln City), reunited the family, and referred the case to Oregon DHS for further investigation.

April 9: Non-Injury Single-Vehicle Crash on US-101, Milepost 162, Yachats A gray Chevy Silverado crashed. No injuries reported. The vehicle was towed by Rowley’s at the owner’s request. Citation/warning issued to David Harold Post, 74, of Yachats.
